This Privacy Policy (hereinafter referred to as “Policy”) shall govern the manner in which LDC collects, uses, maintains and discloses Your Information, as described under this Policy, obtained when You access LDC’s Website.

This Policy may be subjected to change from time to time and such change shall be effective upon being posted on LDC’s Website, and accordingly You are advised to refer back to Policy from time to time.

In the event You disagree to such changes, Your sole remedy is to stop accessing, using LDC’s Website. Your continuous access and use to LDC’s Website will be deemed as an acceptance to such changes.

In the event of any conflict between this Policy and any other LDC’s Policies in respect of the privacy and confidentiality, this Policy shall prevail.

1. The Information Collected by LDC (“Information”)

1.1. The Information include the following:

  • 1.1.1 Your Personal Information that You submit voluntary. You can refuse to submit Your Personal Information, but in this event, You may not be able neither to create Your Account nor to use any of the Online Service.
  • 1.1.2 The Communications provided from Your side to LDC.
  • 1.1.3 The complains provided from Your side to LDC.
  • 1.1.4 All activities/transactions made from Your side on Your Account and/or LDC’s Website.
  • 1.1.5 Non-Personnel Information
    • (i) LDC may collect Non-Personal Information about You whenever You interact with LDC’s Website. Non-Personal Information may include with no limitation the browser name, ip address, user id, the type of the computer and Your technical information such as means of connection with LDC’s Website, operating system and internet service providers utilized and other similar information.

  • 4.3 You agree that LDC disclose Your Information as follow:
    • 4.3.1 LDC reserves the right to disclose Your Information to third-party service provider(s) to perform functions on behalf of LDC (Example: providing marketing assistance, processing payments, analyzing data).
    • 4.3.2 LDC reserves the right to disclose Your Information in the event of a business transfers: As LDC continues to develop its business, LDC may sell or buy other businesses or services, or if LDC’s asset are acquired, in such transactions, Your Information is one of the transferred business assets.
    • 4.3.3 LDC reserves the right to disclose Your Information with third party (i) to protect LDC’s rights; (ii) take precautions against liability; (iii) to investigate and defend LDC against any third-party claims or allegations; (iv) to enforce the execution of LDC’s Policies; and/or (v) to detect fraud and abuse.
    • 4.3.4 LDC reserves the right to disclose Your Information with any regulatory, governmental, security and/or judicial authority, LDC shall assume Your rejection/refusal to provide Your Information to the local jurisdiction/competent authority on demand, and LDC shall act accordingly except when the local jurisdiction/competent authority overrides this Policy.
      (i) For the sake of clarity, in the event a local jurisdiction/competent authority has requested the disclosure of Your Informational, LDC will give You, where practicable, prompt notice of the receipt of such requirement in order to permit You to seek to interpose an objection or obtain an order preventing or affecting such disclosure of Your Information.
    • 4.3.5 LDC reserves the right to disclose Your Information with LDC’s managers, employees, lawyers and /or accountants, only on a need-to-know basis and as necessary for the fulfilment of the obligations of LDC under LDC’s Policies.
    • 4.3.6 In the event of disclosing Your Information to a third part, such third party will (i) use Your Information in accordance with this Policy and with the law; and (ii) use Your Information solely for the purpose of performing such third party’s functions in accordance with LDC instructions, and not for any other purpose.
    • 4.3.7 If LDC needs to disclose Your Information with a third party, for a purpose other than the aforementioned indicated under this article, LDC shall take Your prior written consent, except in respect of Your Feedback (LDC reserves the right to use Your Feedback as described under LDC’s terms of service).

5. Disclaimer

  • 5.1 LDC cannot guarantee that Your Information will not be subject to any loss, destruction, alteration or disclosure. When You provide LDC with Your Information, You do so at Your own risk. LDC will notify You in the event of a material breach of security, which resulted in an unauthorized disclosure of Your Information.
  • 5.2 Regarding Your credit card, LDC has no access to Your credit card/visa card that You use while subscribing on the Online Service.

6. Data Protection

  • 6.1 LDC implements appropriate security measures to protect Your Personal Information from unauthorized access, alteration, disclosure, or destruction.
  • 6.2 LDC maintains appropriate security measures to protect Your Information and to avoid any lost, unauthorized use, unauthorized access, unauthorized alteration or unauthorized disclosed. LDC use appropriate security measures to prevent Your Information from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed.
    • 6.2.1 Example of using security measures to protect Your Information: using encryption protocols and software during transmission of Information, on-host firewall technology, and following the payment card industry data security standard (PCI DSS) when handling credit card data.

  • 6.4 It is Your responsibility to keep in strict confidentiality the password of Your Account, and to maintain the security of Your devices that You use in connection with LDC’s Website.
  • 6.5 Data retention: You agree that LDC reserves the right, at its sole discretion, to archive Your Information as long as necessary to LDC, and/or as required by law.

  • 7.3 In the event LDC is selling You its own Online Service, LDC is the data controller and processor of the Information collected from LDC’s Website, and such Information does not leave LDC premise or the Egyptian jurisdiction.

LDC’s Website may include third party advertising and links to third-party websites., such advertisings and third party’s website may collect information about You when You interact with them. Such advertisings and third party’s websites are not under LDC’s control, and LDC neither makes any representations nor endorses such advertisings and/or third-party websites. LDC encourages You to review the privacy policy related to such third parties before submitting Your Information.

9. Miscellaneous

  • 9.1 You reserve the right to choose not to provide LDC certain Information, but in this case You might not be able to access and use LDC’s Website and/or the Online Service.
    • 9.1.1 You reserve the right to refuse receiving future marketing communications from LDC by adjusting Your customer communication preferences.
    • 9.1.2 LDC’s system will place cookies when You log on to LDC’s Website and this is to ensure that You are able to access and use all aspects of LDC’s Website. If You disable cookies, it may affect how LDC’s Website works and You may not be able to take advantage of certain features/functions of LDC’s Website.

10. Access and Update Your Information

You reserve the right to access some of Your Information on LDC’s Website, including with no limitation name, password, payment details, email address, and the history of Your order(s), and certain Information are editable, noting that all the versions of Your updates are kept for LDC’s record.

    You have the right to access Your Personal Information provided at Your discretion, that is mandatory for LDC Online Services from Your dashboard.
    You may object to its processing or erase Your data, in this case, You have to eliminate the Online Services provided to You by LDC by raising a support ticket or contacting Your support agent.

    You have the right to receive Your Personal Information in a structured, commonly used, and machine-readable format.

11. Deletion of Your Account

In the event of deleting Your Account, Your Information shall be deleted. LDC may retain certain Information by law and for LDC’s business purposes.

12. Violation

  • 12.1 If Your registration as a Client has been suspended, You can ask LDC to activate Your registration upon You provide the following, and LDC reserves its right to accept or reject such activation request:
    • (i) The reasons for the suspension.
    • (ii) The solutions made by Your side in order to avoid any further suspension.
    • (iii) an acknowledgment issued from Your side stating that You will no longer make any violation/infringement to LDC’s rights and/or third party’s rights.
  • 12.2 If Your registration as a Client has been terminated by LDC, You will not be able to create any other registration on LDC’s Website.
  • 12.3 LDC reserves the right to pursue any and all remedies available to it as a result of Your violation of this Policy.
  • 12.4 Submitting a Complaint
    • 12.4.1 If You want to submit a complaint related to any violation to this Policy, You must submit a complaint to LDC through Your dashboard, and You agree to include the following in Your complaint:
    • (i) Identification of the work claimed to have been infringed.
    • (ii) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit LDC to locate the material.
    • (iii) Information reasonably sufficient to permit LDC to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
    • (iv) A statement that the information in the notification is accurate.
    • (v) LDC reserves the right to ask for any further requirements.
    • (vi) Upon You submit Your complaint to LDC, LDC reserves the right to use, Reproduce, modify, adapt, publish, translate, create derivative works from, and display Your complaint throughout the world in any media.

  • -Client: means a natural person who register himself as a client on LDC’s Website in order to be able to subscribe on the Online Service via LDC’s Website.
  • - Communications: means all information that You give to LDC through chat via LDC’s Website, email and/or telephone.
  • - Feedback: means any reviews, comment, suggestion, ideas, recommendations, and/or data provided from Your side on LDC’s Website.
  • - LDC: means company of Link Datacenter for Data Exchange L.L.C., commercial register number: 101146.
  • - LDC’s Website: means www.linkdatacenter.net
  • - LDC’s Policies: means the terms of service, and intellectual property rights policy, and all terms and regulations issued by LDC and posted on LDC’s Website.
  • - Microsoft Office 365 means services owned by Microsoft, and LDC is resell and provide such Service to You, and as described under LDC’s Website.
  • - Non-Personnel Information: means the data that doesn’t identify You.
  • - Online Service: means the following services that You subscribe to them through LDC’s Website:
    • VPS (including fully management service, os management service, un-management service)
    • Website hosting
    • Website builder
    • SSL certificate
    • .Eg Domain
    • Enom Domain
    • Microsoft Office 365
    • Microsoft hosted exchange and/or
    • Professional business email
  • - Personal Information: means the information provided from Your side that identify You.
  • - You: means the individual who access and/or use LDC’s Website, and/or the Client (hereinafter referred to as “You” or “Your”).
